Service Scope
SURKAH provides branding, design systems, digital experiences, packaging, and creative strategy. The specifics of each project are defined in its individual agreement.
Project Terms
All projects require a signed agreement and a non-refundable 50% deposit before work begins. Deliverables are defined up front. Any change to the scope must be approved in writing and may affect cost and timelines.
Revisions & Approvals
Each project includes a set number of revision rounds, detailed in the agreement. Extra revisions beyond that scope are billed separately. Clients are responsible for timely feedback and approvals to keep the project on schedule.
Intellectual Property
Clients own all final deliverables once full payment is received. SURKAH retains rights to unused concepts, working files, and the ability to showcase completed work in our portfolio unless otherwise agreed in writing.
Usage Rights & Licensing
Final deliverables are licensed for the purposes outlined in the project agreement (e.g., brand identity, digital, packaging). Any use outside that scope, resale, third-party licensing, or redistribution requires separate written approval.
Third-Party Assets
If stock photography, fonts, plugins, or other third-party assets are required, the client must purchase directly. Responsibility for usage rights lies with the client.
Payment Structure
Project fees are outlined in each agreement. A deposit is required before work commences, and the final payment must be received before the delivery of the final files. Costs for third-party services, rush fees, or out-of-scope changes will be billed separately.
Timeline & Communication
Clients are expected to provide accurate content, brand assets, and feedback on time. SURKAH is not responsible for delays caused by late submissions or unclear directions.

File Delivery & Archiving
Final files are delivered once the project balance is paid in full. SURKAH keeps project files archived for 12 months. Long-term storage or re-delivery beyond this period may incur additional fees.
Confidentiality
We maintain strict confidentiality of all client information. NDAs are available upon request, and confidentiality agreements are honoured in full.
Indemnity
Clients are responsible for ensuring that all content (images, text, logos, trademarks, etc.) provided to SURKAH is legally owned or licensed. SURKAH is not liable for claims arising from unauthorized or infringing materials supplied by the client.
Termination Rights
Either party may terminate a project with written notice. Clients are responsible for payment of all completed work up to the date of termination. Kill fees may apply as outlined in the project agreement.
Force Majeure
SURKAH is not liable for delays or non-performance caused by events beyond reasonable control, including natural disasters, government actions, power failures, or internet outages.
Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through direct discussion first. If unresolved, disputes will be handled under the laws of Alberta, Canada.
Liability
All services are provided "as is," with no guarantee of specific outcomes. SURKAH's liability is strictly limited to the total fees paid for the project.
